Apartment: Arizona Landlord/ Tenant Bed Bug Law

It’s important to know the AZ State laws  if you are a Tenant or a Landlord. Below is a great article written by AZ Central regarding bedbug law for apartments/ multi-family housing.

“It’s important to work with your apartment management company or owner when you think you have bed bugs, and there are very specific “bed bug rules” under Arizona law which both the landlord and tenant must follow. They see infestations may have already spread to more than one apartment, and your managers must bring in a licensed professional to assess and treat the problem.

Residents shouldn’t try to treat a bed-bug problem on their own. Over-the-counter treatments may make the problem worse, and under state law, you could be legally liable for the costs of treating the affected apartments if you don’t follow the correct procedures.

Here’s what to do if you think you have bed bugs:

1. Notify your apartment manager or owner immediately. They will brief you on their specific bed-bug protocol for addressing bed bugs.

2. Do not try to treat these bugs yourself! Do not buy any hardware-store pesticide and spray them. Over-the-counter treatments may worsen make the problem worse, and under state law, you could be legally liable for the costs of treating the affected apartments if you don’t follow the correct procedures.

3. Ask your apartment manager or owner what they recommend about your personal items like clothes and furniture. They will typically recommend washing clothing and sheets in hot water.

Arizona’s bed-bug law applies only to apartments (single family homes are exempt), and the law states that you have three business days to notify your landlord in writing that you suspect that you have bed bugs. The landlord must have a a licensed pest-control professional inspect your unit within  seven days of after receiving your written notice. They will have an inspection done by a licensed pest-control professional. Bed bugs move fast, so they will likely also inspect units near yours to see whether if other apartments have been infested, too. Your management company will work with you to treat your unit. In addition, your apartment manager will likely have protocols for you to follow to clean your personal items to ensure that all of the bed bugs are gone. This could include washing clothing and sheets in hot water. If you don’t follow these protocols, and the issue continues, your management company may be able to charge you for the full cost of treating your unit and other affected apartments.”

I just found a bed bug, what do I do?!?

Bed bugs… So you thought they were a myth. A silly thing your mom would say as she put you to bed at night, “Don’t let the bed bugs bite,” well not such a sweet sentiment as you find one crawling across your pillow.

So what do you do? Let me guess.. You hop on the internet only to discover that in fact you just found a bed bug. So now what? Fight that instinct that is telling you to drag your bed through your whole home!

How do you know if you have bed bugs?

Bed bug and bed bug eggs are visible to the human eye. There are a few things you can look for to identify if you have a bed bug problem.

-Bites! Have you been getting unexplained bite on your body?

-Black spots on your mattress. Bed bugs leave fecal stains on your mattress. They appear black in color after digesting their meal… which is our blood.

-Blood smears on sheets. After they pierce your skin you may bleed and leave a blood smear on the sheets. BedBug

-A Bug… Did you find a bug that resembles an apple seed?

-Small white, oval sticky eggs

-Cast skins. BedBugs molt and leave a crunchy cast skin.

-An odor. A heavy infestation can leave a sweet smelling odor

Bed Bug Bites

Bed Bugs are mostly active at night. Attracted by our Co2, they attack us while we are most vulnerable-Sleeping. Bed Bug bites can affect each individual quite differently. Some of us wont have a reaction to their saliva at all, while others can have severe reactions.  This could explain why your spouse thinks he/she isn’t getting bit, and you are.

Bed Bugs feed  on us by piercing our skin and withdrawing blood . They can feed from three to 10 minutes. They become engorged and then crawl away unnoticed into even the smallest crack or crevice.

Most bed bug bites are painless at first, but later can turn into itchy welts if you have an allergic reaction. While bed bugs aren’t proven to cause disease they can lead to secondary infections like MRSA if allergic reaction is severe.
